Introduction

In the event of a booking made through a third-party platform (Airbnb, Booking.com, etc.), the terms and conditions of the respective platform will supersede these Terms and Conditions.

The property is a former coal cellar, transformed into accommodation for 1 to 2 people. Commercial name: Gîte de l’Imaginaire.

Rental agreement

A rental contract is agreed upon between the parties, either as a document or tacitly through the communication of the rental terms by email. This contract concerns a short-term rental of a furnished tourism property.

In accordance with French law, short-term stays must be subject to a rental contract, which may be concluded electronically. An exchange of emails, including the provision of a property description, may constitute a contract. In this case, the email will specify:

The property description

The parties acknowledge that this contract is not intended for the rental of premises for primary residential use or mixed professional and residential use. The rental contract concerns a short-term lease of a furnished tourism property. Accordingly, the parties agree that their respective rights and obligations will be governed by the stipulations of the contract, by the decree of December 28, 1976, as amended, and, failing that, by the provisions of the French Civil Code.

Duration of stay

The tenant signing this contract may not, under any circumstances, claim any right to remain in the premises after the end of the stay.

Booking and payment

The reservation becomes effective as soon as the tenant has sent the full rental amount, a signed copy of the rental contract, and a copy of their identification to the owner. 

To proceed with the booking of the accommodation:

1) In the case of a contractual document, the tenant returns it by email, initialed and signed in the indicated places, with the note "Read and Approved." If it is not possible to return the contract by email and with the owner's agreement or to simplify the booking process: EITHER the contract will be completed and handed over on the first day of arrival OR a simple acknowledgment of receipt will be requested by email. Acknowledging receipt of the contract is considered acceptance of the Terms and Conditions.

2) In the case of communication of the rental terms by email, a simple exchange of emails between the owner and the tenant is considered acceptance of the Terms and Conditions unless the tenant expresses refusal or disagreement during the exchanges.

Cancellation policy

By the owner:

In the event of cancellation by the owner, the tenant will be refunded all amounts paid in advance.

By the tenant:

Any cancellation must be notified by registered letter with acknowledgment of receipt, by email, or by any other means made available. 

Cancellation more than 30 days before arrival: the stay is refunded, minus fees (PayPal, Stripe).

Cancellation between 30 and 7 days before arrival: 50% of the total stay amount is due.

Cancellation less than 7 days before arrival: 100% of the total stay amount is due.

Additionally, if the tenant does not arrive on the day specified in the contract and fails to communicate within 24 hours, the rental contract becomes void, the owner may re-rent the accommodation, and all amounts paid remain with the owner.

Arrival and departure

Check-in is from 5:00 PM, and check-out is before 11:00 AM. Any arrival or departure outside of these hours must be specified and validated in advance. The check-in is typically conducted by the owner; however, the owner reserves the right to provide the key in a secure lockbox with a code. 

Use of the premises

The tenant must ensure the peaceful use of the property and use it in accordance with its intended purpose. 

Capacity

The number of occupants in the property must not exceed the capacity indicated in the description (2 people) based on the available equipment. This limit cannot be exceeded for safety and insurance reasons. If this clause is not respected, the owner reserves the right to refuse additional occupants.

Pets

Pets are not allowed in the gîte.

Smoking

Smoking is prohibited inside the gîte. 

Insurance

The tenant is responsible for any damage caused during their stay. The tenant is required to have a holiday rental insurance policy covering these risks. Proof of insurance may be requested.

Inventory and inspection

An inventory and inspection of the furniture and equipment will be carried out at the beginning and end of the stay. Any claims regarding the inventory must be made within 24 hours of check-in and within 7 days after check-out. 

Applicable law and jurisdiction

These general terms and conditions are governed by French law. In the event of a dispute, the court of the owner's domicile will have sole jurisdiction.

Storage and safekeeping of personal belongings

The owner declines all responsibility in case of loss, theft, or damage to the tenant's personal belongings.

Special conditions

The tenant agrees to comply with the safety instructions and rules of the gîte. Failure to comply with these rules may result in penalties, including immediate eviction without refund.
